1. General Terms

1.1. Parties

These Terms of Service ("Terms") govern the legal relationship between:

Day and Night Jet Ski Dubai ("Day and Night", "we", "us", or "our"), as the tour operator, and

Customers ("you", "your", or "Customer"), as participants in our guided water sports tours.

Day and Night operates guided jet ski and jet car tours in Dubai, United Arab Emirates, offering premium water sports experiences through our website at dayandnight-jetskidubai.com and related booking platforms.

1.2. Acceptance of Terms

By booking a tour, participating in our activities, or accessing our website, you enter into a legally binding agreement with Day and Night according to these Terms. This agreement remains in effect until your tour is completed and all obligations are fulfilled.

These Terms are supplemented by our Privacy Policy, which is binding for all users.

1.3. Scope of Application

These Terms apply to:

• The website www.dayandnight-jetskidubai.com
• All tour bookings made through our website or booking platform (Bokun)
• All guided jet ski and jet car tours provided by Day and Night
• Any related services or activities

The validity of these Terms can only be waived by express written agreement.

1.4. Modifications to Terms

Day and Night may make minor changes to these Terms at any time without notifying users. The current version of the Terms is always available on our website.

Significant changes to the Terms will be displayed to users when making a booking. Acceptance of modified terms is deemed given if not objected to in writing within 5 business days of notification, or upon making a new booking after changes are published.

1.5. Eligibility

Our tours are available to individuals who:

• Are at least 16 years old to operate a jet ski
• Can provide valid identification
• Meet physical requirements for water sports activities
• Can swim or agree to wear provided safety equipment
• Are not under the influence of alcohol or drugs
• Sign our liability waiver and safety acknowledgment
• Can understand and follow guide instructions (in English or Arabic)

For participants under 18:

• Ages 10-15: Must ride as passenger with an adult
• Ages 16-17: May operate with parental consent and supervision
• Parent/guardian must sign waiver for all minors

2. Tour Booking and Service Terms

2.1. Making a Tour Booking

Tour bookings can be made through:

• Our website (via Bokun booking system)
• Phone reservations (additional fee of AED 50 may apply)

When booking a tour, you must provide:

• Accurate personal information for all participants
• Contact details for emergency purposes
• Number of participants
• Preferred tour date and time
• Any special requirements, medical conditions, or mobility limitations
• Hotel/accommodation details for pickup (if applicable)

2.2. Tour Confirmation

Once your booking is submitted and payment processed, you will receive a confirmation email. This confirmation includes:

• Tour date and time
• Meeting location or pickup details
• What to bring
• Contact information for the day of tour
• Booking reference number

2.3. Pricing

2.3.1. Prices

All prices displayed are in AED (UAE Dirhams) and are per person unless otherwise stated.

Guided tour prices include:

• Professional certified tour guide
• Safety equipment (life jacket, whistle)
• Safety briefing and training
• Fuel
• Bottled water
• Basic photos (additional professional photography available)

Prices do not include:

• Hotel transfers (unless specified)
• Professional photography/videography packages
• Tips for guides
• Personal expenses
• Travel insurance

2.3.2. Payment Methods

We accept:

• Credit/debit cards (processed through Bokun)

Full payment is required at the time of booking.

2.4. Cancellation Policy

2.4.1. All Bookings Are Final

All bookings are final and non-refundable. Once you have completed your booking and payment has been processed, no cancellations, changes, or refunds will be provided for any reason, including but not limited to:

• Change of plans or schedule conflicts
• Medical conditions or illness
• Travel delays or cancellations
• Weather concerns (unless we cancel)
• No-show for any reason
• Late arrival resulting in missed tour
• Inability to participate due to not meeting requirements

2.4.2. Weather Cancellations by Day and Night

We reserve the right to cancel tours due to unsafe conditions:

• High winds or storms
• Poor visibility
• Rough sea conditions
• Government advisories or marine warnings

Only if we cancel due to weather or safety concerns, you will receive:

• Full refund, or
• Option to reschedule to another available date (subject to availability)

2.4.3. Operational Cancellations by Day and Night

If we cancel for operational reasons (mechanical issues, staff emergencies), you will receive a full refund. This is the only other circumstance where refunds are provided.

2.4.4. Important Notice

By completing your booking, you acknowledge and accept that:

• You have read and understood this no-refund policy
• All sales are final
• You are committing to the selected date and time
• We strongly recommend travel insurance that covers water sports activities

3. Tour Safety and Participation Requirements

3.1. Pre-Tour Requirements

3.1.1. Arrival Time

You must arrive at least 30 minutes before scheduled tour time for:

• Check-in and documentation
• Safety briefing
• Equipment fitting
• Training session

Late arrivals may result in shortened tour time or cancellation without refund.

3.1.2. Documentation

You must present:

• Valid photo ID or passport
• Booking confirmation
• Signed liability waiver (can be completed on-site)

3.2. Safety Briefing and Training

All participants must:

• Attend mandatory safety briefing
• Complete basic operational training
• Demonstrate understanding of hand signals
• Follow all guide instructions
• Pass basic competency check before tour begins

3.3. During the Tour

3.3.1. Following the Guide

Participants must:

• Stay with the group at all times
• Maintain visual contact with the guide
• Follow the designated route
• Respond immediately to guide signals
• Not overtake the lead guide
• Maintain safe distances between jet skis

3.3.2. Prohibited Activities

The following are strictly prohibited:

• Operating under influence of alcohol/drugs
• Reckless driving or dangerous maneuvers
• Leaving the tour group
• Racing or competing with other participants
• Standing or trick riding
• Allowing non-participants to operate equipment
• Using mobile phones while operating
• Removing safety equipment

3.4. Tour Routes and Conditions

• Routes may be modified based on weather and sea conditions
• Tour duration includes safety briefing and training time
• Actual riding time varies by package
• Tours may include photo stops at designated locations
• Wildlife viewing is not guaranteed

4. Liability and Insurance

4.1. Assumption of Risk

Jet ski tours involve inherent risks. By participating, you acknowledge and accept risks including but not limited to:

• Falling from jet ski
• Collision with objects or other watercraft
• Mechanical failure
• Weather changes
• Marine life encounters
• Injuries from improper operation
• Sun exposure and dehydration

4.2. Liability Limitation

Day and Night's liability is limited to:

• Cases of gross negligence or willful misconduct by our staff
• Personal injury directly caused by defective equipment
• Maximum compensation of AED 10,000 per incident

We are not liable for:

• Injuries resulting from failure to follow guide instructions
• Loss or damage to personal belongings
• Pre-existing medical conditions
• Indirect or consequential damages
• Acts of nature or force majeure
• Third-party actions

4.3. Participant Liability

You are fully liable for:

• Damage to equipment caused by negligence or misconduct
• Injuries or damage caused to other participants or third parties
• Costs of search and rescue if you leave the tour group
• Fines or penalties for violating maritime regulations
• Environmental damage caused by your actions

4.4. Insurance

We maintain comprehensive liability insurance for our tour operations. We strongly recommend participants have:

• Travel insurance
• Medical insurance covering water sports
• Personal accident insurance

5. Health and Medical Considerations

5.1. Medical Fitness

Participants must be in reasonable physical health. Tours are not suitable for those with:

• Heart conditions
• Epilepsy
• Recent surgeries
• Pregnancy
• Severe motion sickness
• Back or neck injuries
• Any condition that impairs judgment or physical ability

5.2. Disclosure Requirement

You must disclose any medical conditions, medications, or physical limitations that could affect your ability to safely participate.

5.3. Right to Refuse Participation

We reserve the right to refuse participation to anyone we deem unfit or unsafe for the activity, with full refund if refused before tour begins.

6. Photography and Media

6.1. Tour Photography

• Basic photos are included in most tours
• Professional photography packages available for additional fee
• Photos typically delivered within 48 hours via email/WhatsApp

6.2. Media Release

By participating, you grant Day and Night permission to:

• Photograph or video you during the tour
• Use such media for marketing purposes
• Share on social media platforms
• Include in promotional materials

You may opt-out of media use by notifying us in writing before the tour.

7. Environmental Responsibility

Participants agree to:

• Respect marine life and habitats
• Not litter or pollute waters
• Follow eco-friendly tour practices
• Report any environmental concerns
• Maintain safe distances from wildlife

8. Dispute Resolution

8.1. Governing Law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai.

8.2. Complaint Procedure

Any complaints should be:

1. Raised immediately with tour guide if during tour
2. Submitted in writing within 48 hours of tour completion
3. Include booking reference and specific details

8.3. Jurisdiction

You agree to the exclusive jurisdiction of the courts of Dubai, UAE for any disputes arising from these Terms or our services.

9. Miscellaneous

9.1. Entire Agreement

These Terms, together with our Privacy Policy and signed waivers, constitute the entire agreement between you and Day and Night.

9.2. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full effect.

9.3. Force Majeure

We are not liable for failures to perform due to circumstances beyond our control, including weather, government actions, or equipment availability.
